These terms and conditions govern the contract of sale between the buyer (hereinafter referred to as the "Buyer") and NUNZIO ALFONSO S.R.L. with registered office in Industrial Area Giammoro - 98042 Pace del Mela (ME) registered with the Messina Companies Register ME-252028, VAT number IT03655770836, PEC address: nunzioalfonsosrl@pec.it (hereinafter referred to as the "Seller").

1. Content of the general terms and conditions of sale

The following general terms and conditions of sale govern all contracts of sale concluded between the Buyer and the Seller through the website www.alfonsoforni.com. Each contract is subject to the general terms and conditions of sale published on the website at the time the contract is concluded.

Any modification proposed by the Buyer is not capable of varying the general terms and conditions of sale unless expressly accepted in writing by the Seller.

2. Contracting parties and geographical area

The online store located at www.alfonsoforni.com is intended for the exclusive use of consumers, i.e., it is reserved for retail sales.

3. Invoices

In the event that it is necessary to issue an invoice to an individual with a VAT number, it will be necessary to indicate both the tax code and the VAT number, as well as the PEC. Without these two pieces of information, an invoice cannot be issued, and the order cannot be processed.

The digital invoice will be sent via email to the address provided during the ordering process.

3.1 Prices

All prices on the website are always expressed in Euros and inclusive of VAT.
For EU companies and non-EU entities, the indicated price is considered net.
The prices of the items do not include shipping costs or any additional costs. An exception is made for the prices of ovens and kneaders, which include the cost of shipping if payment is made by bank/postal transfer. Other payment methods may incur additional costs or commission fees (such as Cash on Delivery), which will appear under Shipping Costs.
The total cost of shipping will be communicated to the customer before confirming the purchase.
The purchase contract is perfected by the accurate completion and consent to the purchase expressed through the "online" adhesion.
The customer can pay for the ordered goods using the payment methods indicated "online" at the time of purchase.

4. Contract finalization

The offers on the website www.alfonsoforni.com are not binding on the Seller and do not constitute a public offer, but a simple "invitation to offer". The Buyer's purchase order constitutes a binding contractual proposal. The purchase order is accepted by the Seller with an Order Receipt sent via email, which includes an excerpt of the sales conditions (product description, price, payment method). The contract is perfected and becomes effective when the Buyer receives the order receipt. The order and the order receipt are considered received when the parties to whom they are addressed have the opportunity to access the telematic messages.

In the event that the Buyer does not receive the Order Receipt from the Seller or any other communication within 48 hours of submitting the order, the Buyer is required to promptly contact the seller through the address: www.alfonsoforni.com

5. Warranty

5.1 Seller's legal warranty

The Seller provides, in accordance with Directive 44/99/EC, a legal warranty on the product for non-conformity to the qualities provided in the sales contract, in compliance with applicable law.

The warranty allows the Buyer, in case of obvious defects or non-conformity of the product, to obtain a replacement, considering that the products are artisanally produced and not serial, which distinguishes them as unique.

In any case, the use of the product not in conformity with that established by the Seller/Manufacturer (instructions for use indicated on the product itself) is not covered by the warranty.

Any complaint must be accompanied by proof of purchase (fiscal document issued by the seller/payment).

5.2 Complaint submission location

The complaint must be submitted by the Buyer promptly and no later than 10 days from the date on which the defect of conformity is discovered.

During this period, the product cannot be used.

The complaint is submitted electronically to the Seller, who will immediately communicate to the Buyer the procedures for returning the product.

6. Products

6.1 Available products and purchase limitations

NUNZIO ALFONSO S.R.L. will not be held responsible in any way for the temporary or definitive unavailability of one or more products. In the event of unavailability, even temporary, of the requested products, NUNZIO ALFONSO S.R.L. undertakes not to charge the Customer the corresponding price. Cases where limitations on the purchase of individual products apply are highlighted on the website.

6.2 Product Images

The graphical appearance of the delivered products may not coincide with that represented on the Website in the event of technical evolutions of the products themselves.

NUNZIO ALFONSO S.R.L. reserves the right to make, in the continuous improvement process of its artisanal products, any technical, dimensional, and aesthetic modifications deemed necessary. Therefore, this cannot constitute the customer's right to request modified products or the cancellation of already placed orders.

6.3 Product Liability

The provisions of Directive 85/374/EEC regarding damage caused by the product apply.

7. Right of withdrawal

Pursuant to Articles 50 et seq. of Legislative Decree no. 206 of September 6, 2005 (Consumer Code) concerning distance contracts, the Buyer is granted the right to withdraw from this contract, without stating reasons and without paying any penalty, within 14 working days from the day of receipt of the goods subject to the contract.

The right of withdrawal is exercised by sending, within the indicated period of 14 days from receipt of the goods, a registered letter with acknowledgment of receipt to the address of the registered office of the Seller (Industrial Area Giammoro - 98042 Pace del Mela (ME) containing the manifestation of will to avail oneself of the right of withdrawal, provided that the integrity of the goods subject to the contract is fully preserved.

The costs of returning the goods are borne by the Buyer.

For the purposes of exercising the right of withdrawal, the consumer must comply with the following conditions: the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g., accessories, attached software, etc.); the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); shipping costs (and any customs charges, if any) relating to the return of the goods are the sole responsibility of the Customer.

The Seller will refund the full amount paid by the Buyer within 14 days from receipt of the notice of withdrawal, using the same payment method used by the Buyer for the initial transaction, unless otherwise agreed. The refund may be suspended until receipt of the goods or until the Buyer demonstrates that the goods have been returned, whichever occurs first.

8. Privacy

The personal data collected will be processed in accordance with the provisions of Regulation (EU) 2016/679 (GDPR) and will be used for the sole purpose of executing the order or sending promotional communications related to the Seller's products, in compliance with the Privacy Policy published on the website.

9. Applicable law

The contract of sale between the Buyer and the Seller is concluded in Italy and governed by Italian law.

For matters not covered by these terms and conditions, the relevant provisions of Italian law apply.

The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

10. Competent court

Any dispute concerning the application, execution, interpretation, and violation of the contracts concluded "online" through the website www.alfonsoforni.com is subject to Italian jurisdiction; these general terms and conditions refer, for everything not expressly provided, to the combined provisions of Legislative Decree no. 50 of 15.1.1992 and Legislative Decree no. 206 of 6.9.2005.

11. Final provisions

These general terms and conditions of sale may be modified at any time by the Seller, without notice. The amendments shall enter into force upon publication on the website and shall apply to sales concluded from that date onwards. The Customer is required to consult the general terms and conditions of sale before making any purchase.

In case of any translation of these general terms and conditions, the Italian text shall prevail in any case.

12. Information on online dispute resolution

Consumers residing in Europe must be aware that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by European consumers to resolve non-judicially any dispute relating to and/or arising from contracts for the sale of goods and services concluded online. Consequently, if you are a European consumer, you can use this platform to resolve any dispute arising from the online contract entered into with the Seller.
